Not every U.S. visa is eligible for premium processing. The service is administered by USCIS and may be requested only for categories the agency has designated as eligible. It is requested through Form I-907, either with the underlying filing or after the case is already pending.
Common temporary worker categories
Nonimmigrant categories frequently associated with premium processing include H-1B, L-1, O-1, E-1, E-2, E-3, TN, P, and Q, as well as certain specific classifications such as H-2B and R-1. For many of these filings, USCIS lists a 15-business-day premium processing timeframe, although the exact category should always be confirmed on the official USCIS page explaining how to request premium processing.
For Brazilian applicants and companies, L-1, O-1, and E-2 categories often arise in business expansion, executive mobility, entrepreneurship, and high-level professional strategies. H-1B may also be relevant, but it depends on an employer, a specialty occupation, and specific selection and filing rules.
Immigrant petition categories
Premium processing may also be available for certain Form I-140 petitions used in employment-based green card cases. This may include categories such as EB-1, EB-2 NIW, and EB-3, depending on the classification and current USCIS eligibility.
Some I-140 filings may have a 45-business-day premium processing window, especially EB-1C and EB-2 NIW cases. That matters because older materials often refer generally to 15 days, which can create inaccurate expectations.
Students and work authorization
Certain Form I-765 applications tied to OPT and STEM OPT and certain Form I-539 requests for F, M, or J change or extension of status may also be eligible. In these cases, the analysis should consider not only the decision timeline but also any additional time needed for EAD card production and delivery.
What premium processing does not cover
B-1/B-2 visitor visas are not expedited through Form I-907. USCIS premium processing also does not replace consular appointment scheduling, visa issuance by the Department of State, CBP admissibility review, or immigrant visa number availability.
The visas eligible for premium processing are concentrated in employment, student-related, and certain immigrant petition categories. Before paying the fee, it is essential to confirm eligibility and determine whether the premium timeline actually solves the strategic issue in the case.
