VISA FOR SKILLED WORKER

The EB-3 VISA IS AIMED AT FOREIGNERS WHO HAVE A PERMANENT FULL-TIME JOB OFFER IN THE UNITED STATES MADE THROUGH LABOR CERTIFICATION.

Foreign applications within this category may vary depending on the scope of the job offer in question. Although eligibility requirements for category EB-3 are less stringent than other categories, there is a long waiting list for some countries.

EB-3 VISA CRITERIA

SPECIAL VISAS BASED ON SPECIFIC PROFESSIONS WITH TABLE A (SCHEDULE A):

Group I – Registered Physical Therapists and Professional Nurses must be licensed in the U.S. state where they reside or plan to reside and graduate from an accredited nursing school in the U.S. or Canada. Physical therapists do not need to be licensed but must meet qualifications to obtain a license from the state. Labor Certification is not required but it is necessary to have an employer in the U.S.

Group II – Professionals in the field of sciences, arts or university professors who attend at least two criteria of extraordinary skills and a job offer. Labor Certification is not required but it is necessary to have an employer in the U.S.

SKILLED WORKERS

  1. Individuals with a minimum of 2 years of training or professional experience in a given area, not being of temporary nature.
  2. You must demonstrate at least 2 years of experience or training in the area of your job offer.
  3. You must perform a job whose skilled workers are not available in the United States.
  4. A full-time permanent Job Offer is required in the United States through Labor Certification.

PROFESSIONALS WITH AN ACADEMIC DEGREE

Intended for individuals who have at least a bachelor’s degree in the USA or an equivalent foreign degree.

  1. You must prove that you have a bachelor’s degree in the U.S. or equivalent foreign degree, and you must also prove that the bachelor’s degree is a requirement normally requested to perform that function of your job offer;
  2. You must perform a job whose skilled workers are not available in the United States;
  3. The bachelor’s degree cannot be replaced by professional experience;
  4. It is necessary to obtain a full-time permanent job offer in the United States through Labor Certification.

WORKERS WITHOUT QUALIFICATIONS

Individuals who will perform work in the United States where less than 2 years of training or experience are required. Cannot be of temporary capacity.

  1. You must demonstrate ability to perform work that requires at least 2 years of experience or training.
  2. You must perform a job whose skilled workers are not available in the United States.
  3. A full-time permanent job offer is required in the United States through Labor Certification.
