GET TO KNOW THE EB-2 VISA -FOR IMMIGRATION OF QUALIFIED PROFESSIONALS IN THE USA.

The EB-2 visa is issued for professionals with successful and above average careers, who have been able to demonstrate exceptional ability in their professional segments and, in many cases, through a higher academic background (at least 1 bachelor’s degree). This visa allows a well-qualified foreigner to receive a green card to live and work permanently in the U.S., contributing to the development of the U.S. market and economy.

TO QUALIFY FOR THE EB-2 VISA, YOU MUST MEET AT LEAST 3 OF THE 7 CRITERIA REQUIRED BY THE U.S. CITIZENSHIP AND IMMIGRATION SERVICES (USCIS).

Below are these criteria:

  1. Academic background and diploma related to your area of professional skill;
  2. Letters and documents that demonstrate at least 10 years of progressive experience in your professional area;
  3. Valid authorization or license to pursue your profession;
  4. Evidence that you received above-average market salaries for your professional contributions;
  5. Have registration or affiliation in a professional association in your professional area;
  6. Documents proving recognition for your achievements and contributions within your professional area;
  7. Other evidence that proves exceptional skill in your professional field.

If your meet at least 3 of the required criteria, you will be classified within one of the 3 subdivisions of the EB-2 visa: national interest, advanced degree or exceptional skill.

 

EB-2 NIW Visa

EB-2 BY NATIONAL INTEREST WAIVER (NIW)

This is the most “famous” of the EB-2 visas. The National Interest Waiver (NIW) means that the person who meets the required criteria does not need an employer or job offer in the U.S., qualifying for the green card only on the basis of his/her own merits and professional and/or academic trajectory to contribute in areas of national interest where there is a great shortage of skilled labor in the country.

Many Brazilians meet the criteria of the EB-2 NIW, mainly engineers, doctors, dentists, nurses, physiotherapists, pilots, IT professionals and a number of other professions that require technical knowledge and experience.

Qualification for the EB-2 NIW is made through proof of professional recognition, national or international awards and certifications, and any other documents demonstrating a successful career and/or an undergraduate course, in addition to meeting at least 3 of the 7 criteria explained above. 

advanced degree visa

EB-2 ADVANCED DEGREE

For this category an employer in the USA is required and the candidate should be hired for having an advanced degree of study in his/her area of activity such as a master’s, doctorate or specialization. In addition, the offer of employment should be related to the area of experience and studies of the applicant.

The employer interested in relying on the services of the foreign professional must justify the entry and permanence of the same in the country and prove that this professional’s qualifications do not exist or are not easy to be found in the United States.

EB-2 FOR EXCEPTIONAL ABILITY

For this EB-2 category you will also need to rely on an employer in the U.S. However, it is not necessary to present certificates and diplomas of an academic degree. Instead, the candidate must demonstrate that he/she has an “exceptional skill” and a level of expertise significantly above what is usually found in the job market. 

ARE FAMILY members of an eb-2 visa holder allowed to live in the u.s.?

Yes. The spouse and unmarried children under the age of 21 of the principal beneficiary (EB-2 visa holder) may be permanently admitted to the United States. If the applicant’s family is already in the United States with an Employment Authorization Document (EAD), his/her spouse is also allowed to work while the EB-2 process is being processed by the U.S. authorities.
